What a replacement bond does

North Carolina makes the surety bond a condition precedent to a collection agency permit under G.S. 58-70-20. The bond runs in favor of the State of North Carolina and has to stay continuously on file — so when an agency changes sureties, corrects a bond, or has one cancelled mid-permit, a replacement bond goes to the Commissioner of Insurance to close the gap.

The amount does not change because it is a replacement: $10,000 for an initial permit, and between $10,000 and $30,000 on a renewal permit, computed from the prior year's collections less commissions. A foreign agency — organized outside North Carolina but inside the United States — files this bond plus the separate nonresident examination-expense bond under subsection (c).

N.C. Gen. Stat. § 58-70-20(a)Section 58-70-20 makes a surety bond a condition precedent to the issuance of any collection agency permit: every applicant files with the Commissioner a bond in favor of the State of North Carolina, executed by a surety company licensed to transact surety business in this State. The bond is $10,000 for the initial permit and, for a renewal permit, no less than $10,000 and no more than $30,000. Because the permit cannot stand without a bond on file, a bond that is cancelled or replaced has to be succeeded by a replacement filing.
