What the right of way bond covers
Any work in a Town of Hempstead right-of-way — a road opening, a curb cut, a utility trench, a sidewalk or apron replacement — needs a permit from the Town of Hempstead Highway Department. Alongside the permit fee and $1,000,000 liability coverage, the Commissioner requires the applicant to post a $5,000 performance bond covering restoration of the highway, sidewalk, pavement, curb, or gutter.
It's a three-party arrangement: you (the principal), the surety carrier, and the Town of Hempstead (the obligee). If you leave a cut unrestored, backfill a trench improperly, or let a restoration fail within the warranty window, the Town can recover against the bond to make the repair good.
