Rockland County right-of-way bonds.
Quote on review.

Any work in or beside a Rockland County road needs a road work permit from the County Superintendent of Highways, who may make a performance bond a condition of approval. The County decides, job by job, whether a bond is needed and how large it must be. A surety specialist returns your price, usually within one business day.

How it works

Built around your county road work permit.

The Permits Division processes the application, an engineer reviews it, and the Superintendent approves it — with the bond on file when it is a condition. Here is the whole process:

TODAY · ONE APPLICATION

Tell us the job and the amount

Apply online with your business details, the bond amount the County set, and a description of the work — the driveway, street connection, curbing, drainage or other work in the county right-of-way. There is no credit section and no SSN field on this application.

WITHIN 1 BUSINESS DAY

A surety specialist underwrites it

The County has already sized the bond to the work, so the review is about the project and the amount. A specialist confirms your exact premium and tells you up front if a large bond needs anything more.

ON APPROVAL

Pay, e-sign & deposit with the County

Once you accept the quote and pay, the executed bond arrives by email with the power of attorney, naming the County of Rockland as obligee and ready to deposit with the Highway Department Permits Division. Wet-ink original mailed on request.

About this bond

What it is and who needs it.

What the Rockland County right-of-way bond guarantees

New York Highway Law § 136, apart from county road work and certain utility and railroad operations, bars any person, firm, corporation or municipality from building an entrance or connection to a county road, or placing any works, structure, crossing, wires, conduits or drainage, sewer or water pipes in the county road right-of-way, except under a work permit from the county superintendent. It also directs each county superintendent to adopt regulations that include a system of deposits of money or bonds guaranteeing the performance of the work.

Rockland County’s Highway Department sets its permit conditions in its Rules and Regulations for Commercial, Industrial, Residential and Subdivision Development. Paragraph 14 of the General Conditions lets the County Highway Superintendent require, as a condition of permit approval, that a performance bond or other surety be deposited with the County to guarantee the proper performance of all work affecting a County Road or facility. The bond backs your other promises under the permit: repairing any damage to the road or drainage system at your expense (¶ 6), protecting traffic throughout construction (¶ 7), and finishing or fixing unsatisfactory work within ten days of written notice — failing which the County may do it at your expense (¶ 9).

Paragraph 15 offers a shortcut for developers already bonding a project with a Town or Village: with that municipality’s consent, the County’s share can be written into the local bond, which must state that the County’s interest is covered and cannot be released without the County Superintendent’s consent. Work that disturbs the road surface or drainage system may also need a separate Road Opening Permit (¶ 13) — confirm its terms with the Permits Division. It is not insurance for you: if the surety pays the County, you repay the surety.

Rockland County Highway Dept. General Conditions ¶ 14; N.Y. Highway Law § 136Paragraph 14 of the Rockland County Highway Department Rules and Regulations for Commercial, Industrial, Residential and Subdivision Development, General Conditions, provides that the County Highway Superintendent may require, as a condition of permit approval, that a performance bond or other surety be deposited with the County to guarantee the proper performance of all work affecting a County Road or facility. Paragraph 15 allows the amount covering work on a County Road to be included, with the consent of the Town or Village, in a bond deposited with that municipality, provided the bond clearly indicates that the County’s interest is covered and will not be released without the consent of the County Superintendent of Highways. Paragraph 8 requires the permittee to obtain or verify public liability and property damage insurance naming the County, and ¶ 10 requires 48 hours’ notice to the Highway Department before work starts. N.Y. Highway Law § 136(1) requires a county superintendent’s work permit for entrances, connections, structures, crossings and utility or drainage lines in the county road right-of-way, and § 136(2) directs the superintendent to establish regulations including a system of deposits of money or bonds guaranteeing performance of the work and insurance requirements protecting the county.

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

Term and renewal are set in the underwriter's quote.

Keep the bond in force for as long as the obligation behind it runs.

How to file it

Pay, e-sign & deposit with the County. Once you accept the quote and pay, the executed bond arrives by email with the power of attorney, naming the County of Rockland as obligee and ready to deposit with the Highway Department Permits Division. Wet-ink original mailed on request.

What sets the price

This bond is underwritten: the premium is quoted from the bond amount and your financial picture, so there is no flat price to show.

FAQ

Common questions.

What is a New York right-of-way bond for Rockland County? It is the performance bond the Rockland County Superintendent of Highways may require before approving a county road work permit. Under ¶ 14 of the Highway Department’s General Conditions it is deposited with the County and guarantees the proper performance of all work affecting a County Road or facility, such as driveways, street connections, curbing, sidewalks and drainage.
Who sets the bond amount? The County does, project by project. Paragraph 14 leaves both whether a bond is required and its size to the Superintendent, and no fixed schedule is published. Call the Permits Division at 845-638-5060 for the figure on your permit and enter it on the application. If a Town or Village is already bonding the project, ¶ 15 may let the County’s share ride on that bond.
How much does it cost?Because the County sets a different amount for each job and this bond is not on our carrier’s published rate sheet, we quote it on review instead of showing a number checkout might not match. Submit the application with the amount and a description of the work, and a surety specialist confirms your exact premium, typically within one business day.
Will I need collateral?Usually not for driveway and small frontage work. A large subdivision or road-widening bond can draw closer review, and in rare cases collateral, because the surety stands behind the finished work. If your file needs anything more, we tell you before you commit. The bond issues the moment you pay — no credit review of any kind, not even a soft pull.
How long does the bond stay in force? It has no fixed term. The bond guarantees the proper performance of the work, so it stays in force until the County accepts the work and releases it. Where the County’s share is folded into a Town or Village bond under ¶ 15, that bond cannot be released without the County Superintendent of Highways’ consent. Keep the bond active until you have that release.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
