Under Chapter 128 of the Village of Potsdam Code ("Peddlers, Solicitors and Transient Merchants"), it is unlawful to act as a vendor, hawker, peddler or solicitor within the Village without first obtaining a license from the Village Clerk. Every applicant must file, along with the application, a $1,000 cash deposit or surety bond — the bond form itself must be approved by the Village Attorney as to form and surety.
The bond is conditioned on final delivery of the goods, wares or merchandise ordered, or services to be performed, in accordance with the terms of the order — or, failing that, on refunding any advance payment the customer made. It also covers reimbursement for fraud, misrepresentation, or any claim arising from a sale. A resident harmed by a licensee's conduct can sue directly on the bond for money or damages.
It is not insurance for you — if the surety pays a claim, you repay the surety. Under Village Code §128-10, the license itself automatically expires on January 1 following issuance (unless it states an earlier date), so most vendors, hawkers, peddlers and solicitors renew the license — and the bond behind it — every year.
