New York licenses individuals and firms to act as agents of an authorized insurer or charitable bail organization in soliciting, negotiating, or effectuating a bail bond deposit — Insurance Law Article 68 governs the business, and § 6802 governs the agent's license itself. Every applicant for that license must file a qualifying bond, approved by the Attorney General as to form and by the Superintendent of Financial Services as to sufficiency, conditioned on the faithful performance of the licensee's duties.
It's a three-party arrangement: you (the principal), the surety carrier, and the Superintendent of Financial Services (the obligee, on behalf of the People of the State of New York), with anyone harmed by a breach of the licensee's duties as the protected party. If a licensed agent breaches those duties, a valid claimant can recover against the bond.
It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must stay in force for as long as the license is active, and DFS bail agent licenses run on a two-year cycle expiring December 1 of even-numbered years, so we track your filing and notify you ahead of renewal.
