About this bond

What it is and who needs it.

What the bond actually guarantees

New Mexico's Weights and Measures Law is enforced by the Department of Agriculture, which registers the service establishments that install, service, repair, and recondition commercial scales, meters, and pumps. A full-service establishment — one that works on devices it does not own — must post a $1,000 surety bond for faithful performance of duty.

The bond is payable to the State of New Mexico and guarantees that the establishment performs its weighing-and-measuring-device work honestly and competently, so that commercial measurements the public relies on are accurate. A limited-service establishment, working only on devices it owns, does not need the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. We issue the $1,000 bond at our $275 minimum with no credit check, and track it so your registration filing stays continuous.

NMSA 1978 § 57-17-1 et seq.; 21.16.5 NMACNew Mexico's Weights and Measures Law (NMSA 1978, Sections 57-17-1 through 57-17-19) and rule 21.16.5 NMAC require a full-service weights and measures establishment to furnish a $1,000 surety bond payable to the State of New Mexico for faithful performance of duty, or other proof of financial responsibility prescribed by the director, filed with the Department of Agriculture. Limited-service establishments are not required to post the bond — confirm your category on your application.

You need this bond if you're

Registering a full-service establishment that services commercial devices for others
Renewing a service-establishment registration that requires the $1,000 bond
Adding device categories that move you from limited to full-service
A scale, pump, or meter service company working on equipment you do not own

Five minutes. The whole thing.

These are the actual issuing fields — no credit check section, because this bond doesn't have one.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the New Mexico weights and measures bond? +
The premium is $275 — our minimum. A flat 3% of the $1,000 bond would be $30, which is below our floor, so the price is $275, the same as every small bond we write.
Do I pay the $1,000? +
No. You pay $275. The $1,000 is the surety's maximum liability to the State of New Mexico if a valid claim is made — not a deposit, and nobody holds your money.
Do limited-service establishments need this bond? +
No. The bond applies to full-service establishments — those that install, service, or repair commercial devices for others. A limited-service establishment, working only on devices it owns, is not required to post it.
Is there a credit check? +
Not on this bond — the application has no credit section at all. Small fixed-amount license bonds like this one don't need one.
When does it renew? +
The bond must stay active for as long as your registration is in force. You can buy a 1, 2, or 3-year term; we send renewal notices 60 and 30 days out, with autopay available.
