What the modular bond actually covers

A modular structure is a building assembled from factory-built sections that meet the same building codes as site-built construction. New Mexico's Construction Industries Division (CID), part of the Regulation and Licensing Department, certifies the manufacturers of these structures and conditions certification on a surety bond.

The bond is a compliance guarantee: it secures that the manufacturer follows the applicable New Mexico statutes, the rules and orders of the Construction Industries Division, and the state's Modular Standards. If a certified manufacturer violates those standards, a harmed party or the state can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. The surety may cancel only on written notice to the Division, with cancellation effective 30 days after receipt. We issue whatever amount the Division set, at a flat 3% with no credit check.
