What the bond actually guarantees

New Jersey licenses student loan servicers under the Student Loan Servicing Act, P.L.2019, c.200 (N.J.S.A. 17:16ZZ-1 et seq.), administered by the Department of Banking and Insurance through NMLS. A servicer must keep on file with the Commissioner a surety bond, obtained from a surety authorized to transact business in this State, in an amount of not less than $30,000.

The Commissioner decides by regulation who is eligible for the protection the bond affords, and may increase the required amount if he determines it necessary. When an action is commenced on the bond the Commissioner may require a new bond, and immediately on any recovery the servicer must file one — the filing is meant to stay continuously in place.

It is not insurance for you — if the surety pays a claim, you repay the surety. The license is administered through NMLS and the bond is filed electronically on your license record; we track your term and send renewal notices 60 and 30 days out.

N.J.S.A. 17:16ZZ-6New Jersey's Student Loan Servicing Act provides that a student loan servicer shall keep on file with the commissioner a surety bond obtained from a surety company authorized to transact business in this State in an amount of not less than $30,000. The commissioner shall by regulation provide who is eligible to receive the protection afforded by the bond and may increase the required bond amount if he determines it to be necessary. When an action is commenced on the bond the commissioner may require the filing of a new bond, and immediately on recovery of any action on the bond the student loan servicer shall file a new bond.
