What the restoration bond actually covers

New Jersey regulates connections to state highways through the State Highway Access Management Code (N.J.A.C. 16:47). Before you build a new driveway or street, or modify an existing access point, you apply to NJDOT for an access permit — and the Department can require a bond as a condition of that permit.

The bond is a restoration guarantee: it stands behind your obligation to restore the portion of the state highway right-of-way disturbed by your access work — pavement, drainage, shoulders, and the like — to the condition NJDOT requires. NJDOT sets the amount based on the scope of the work, so it is not a single statutory figure.

If you fail to restore the area, NJDOT can recover against the bond to have the work done — and if the surety pays, you repay the surety. It is not insurance for you; it is the Department's assurance that the public road is put back right.
