What the fuel bond actually covers

Nevada taxes motor fuel under NRS Chapter 365 and special fuel under NRS Chapter 366, administered by the DMV's Motor Carrier Division. A licensed fuel supplier, dealer, manufacturer, or user files a surety bond conditioned on the faithful performance of the chapter and the punctual payment of all fuel excise taxes, penalties, and interest owed to the State of Nevada.

The bond is filed on the DMV's MC 035 (Surety Bond to Secure Performance under NRS Chapters 360A, 365, 366 & 590), payable to the State of Nevada. The amount is set by the DMV from your estimated taxable gallons, and by statute it cannot be less than $2,500.

If the partnership collects or owes fuel tax and fails to remit, the state can recover against the bond — and if the surety pays, the partnership repays the surety. This page is the partnership version; sole proprietors and corporations file the same bond as an individual or corporation.
