To obtain or renew a pharmaceutical drug facility permit from the Mississippi Board of Pharmacy, a facility must provide evidence of a surety bond. Every facility that engages in the wholesale distribution of prescription drugs, active pharmaceutical ingredients, or devices as defined in Miss. Code Ann. § 73-21-71 — manufacturing in the state, distributing into it, selling or offering to sell in it, or distributing from or within it — must register annually with the Mississippi Board of Pharmacy. The permit types run wider than the word “wholesaler” suggests: manufacturer, virtual manufacturer, wholesaler, virtual wholesaler, third-party logistics provider, repackager, outsourcer, reverse distributor, private label distributor, and veterinary wholesaler each sit under the same permit rule.
Article XXXII of the Board’s regulations makes the bond a condition of getting or keeping that permit: an applicant must provide evidence of a surety bond in the amount of $100,000 — reduced to $25,000 only for a facility or business whose annual gross receipts totalled $10,000,000 or less for the previous tax year — or other equivalent means of security acceptable to the State. Which tier you file is a function of last year’s receipts, not of your permit type, so a fast-growing distributor can cross the line between one renewal and the next.
The bond runs to the State of Mississippi for the Board’s benefit, and it backs the facility’s compliance with the Pharmacy Practice Act and the Board’s rules — including administrative penalties and the Board’s costs of enforcement where the permit-holder fails to pay them. It is not insurance for you: if the surety pays, you repay the surety. Keep it continuous, because the permit is annual and a renewal application that is not approved before the permit expires stops your Mississippi operations until it is.
