What the bond actually guarantees

Michigan licenses driver education providers through the Secretary of State under the Driver Education Provider and Instructor Act (Act 384 of 2006). A commercial vehicle driver education provider — a truck/CDL training school — must post a $50,000 bond, the largest tier in the act (other schools post $20,000 or $40,000 depending on enrollment).

The bond protects students, financing agencies, and government agencies against monetary loss caused by fraud, cheating, or misrepresentation in the conduct of the provider's business. A claim is paid only after a court of record enters judgment for fraud, cheating, or misrepresentation, and the surety's total liability never exceeds the $50,000 face amount.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must be maintained continuously to protect students' contractual rights; the surety can cancel only on 30 days' written notice to the Secretary of State, so we track it and notify you well ahead of expiration.

MCL 256.629 (Act 384 of 2006)Under MCL 256.629, the bond of a commercial vehicle driver education provider must be in the principal sum of $50,000.00, with surety approved by the Secretary of State. It indemnifies students, financing agencies, and governmental agencies for loss from fraud, cheating, or misrepresentation, payable only after a court judgment, with aggregate liability capped at the bond amount.
