What the bond actually guarantees

Michigan regulates companies that purchase and finance motor vehicle installment sale contracts under the Motor Vehicle Sales Finance Act, 1950 (Ex. Sess.) PA 27. A separate license is required for each place of business — and under MCL 492.105, a $10,000 bond accompanies each application for an additional location, alongside the $20,000 bond on the principal place of business.

The bond is executed to the State of Michigan for the use of the state and any person — conditioned on the licensee complying with the act and the administrator’s rules, and paying any money that becomes due to the state or to any person under the act. A person with an unsatisfied judgment against the licensee can sue on the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. A new bond or renewal certificate must be filed annually at least 15 days before July 1; we track the term and send renewal notices 60 and 30 days out.

MCL 492.105Section 5 of the Motor Vehicle Sales Finance Act requires a bond in the penal sum of $20,000.00 with the first application for a sales finance company license, applicable to the principal place of business, and a bond in the penal sum of $10,000.00 with each application for an additional location. The bond is executed to the State of Michigan, conditioned on compliance with the act, and a new bond or renewal certificate is filed annually at least 15 days before July 1.
