Kentucky regulates mortgage loan companies and mortgage loan brokers under KRS Subtitle 286.8, administered by the Department of Financial Institutions through NMLS. A mortgage loan broker — a person compensated for serving as an agent in arranging residential mortgage loans — posts a $50,000 corporate surety bond under KRS 286.8-060 as a condition of the license.

It's a three-party arrangement: you (the principal), the surety carrier, and the Commonwealth of Kentucky (the obligee). The bond stands behind your compliance with Subtitle 286.8 — the licensing, disclosure, and conduct rules that protect Kentucky borrowers — and gives a consumer harmed in a brokered loan transaction a source of recovery up to the bond amount.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must stay on file for the life of the license and cannot lapse without notice to the DFI, so it has to remain continuously in force; we track the term and send renewal notices 60 and 30 days out.
