A vehicle title service agent is defined by K.S.A. 8-2601 as a person who, for a fee, acts as someone else’s agent in applying for or obtaining a certificate of title, a registration or licence plate, or a registration renewal — and, for a licensed Kansas dealer, in obtaining temporary registrations, title assignment addendums, or sales tax receipt books. Licensed vehicle dealers are excluded, and so is anyone dealing exclusively in commercial vehicles. If you run title and tag work for dealers or the public and you are not the dealer yourself, this is your licence.
The bond exists because the job puts other people’s money and other people’s ownership documents in your hands. It runs to the State of Kansas for the benefit of any aggrieved retail or wholesale buyer or seller of a vehicle, and it indemnifies them for loss caused by acts that would be grounds to suspend or revoke your licence — a title that never gets perfected, fees collected and not remitted, paperwork filed wrong. A buyer who is harmed can recover against the bond up to $25,000.
It is not insurance for you. If the surety pays a claim, you repay the surety. Keep the bond in force for the whole life of the licence: the surety can cancel only on 30 days’ notice to the director, but a licence without a bond behind it is revoked, so we track your expiry and notify you 60 and 30 days out. Because every Kansas licence in this family expires on December 31, a 2 or 3-year bond term is usually the cheaper way to stay continuous.
