What the pesticide business bond covers

Kansas licenses pesticide businesses through the Department of Agriculture, and under K.S.A. 2-2448 the secretary will not issue the license until the applicant furnishes proof of financial responsibility — which can be a surety bond of not less than $6,000 per year (a certificate of liability insurance is the alternative).

The bond runs to the State of Kansas and is conditioned on compliance by the business and its officers, agents, and employees with the Kansas pesticide law. It protects people and property from harm caused by negligent or improper pesticide application.

It is not insurance for you — if the surety pays a claim for damage you caused, you repay the surety. As of January 1, 2025, every pesticide business licensee or applicant must have a liability certificate or surety bond on file with the secretary.
