What the bond actually guarantees

Kansas regulates mortgage companies under the Kansas Mortgage Business Act, administered by the Office of the State Bank Commissioner. K.S.A. 9-2211 requires each applicant and licensee to file a surety bond of not less than $100,000 — or the amount the commissioner establishes by regulation. The commissioner's tiers put higher-volume mortgage companies at $125,000, the amount this page covers, payable to the OSBC and filed electronically through NMLS.

It's a three-party arrangement: you (the principal), the surety carrier, and the Office of the State Bank Commissioner (the obligee). The bond secures your compliance with the Kansas Mortgage Business Act — the licensing, conduct, and consumer-protection rules that govern mortgage business with Kansas borrowers.

It is not insurance for you — if the surety pays a claim, you repay the surety. The statute keeps the surety liable for conduct that occurred while the license was active for two years after the bond is cancelled, and the bond must stay continuously on file; we track the term and send renewal notices 60 and 30 days out.

K.S.A. 9-2211Under the Kansas Mortgage Business Act, each applicant or licensee shall file with the commissioner a surety bond in the amount of not less than $100,000, or the amount established by the commissioner by rules and regulations, payable to the office of the state bank commissioner — with a higher $125,000 tier applying to licensees with larger Kansas loan volume.
