What it is and who needs it.

What the bond actually guarantees

Kansas licenses microdistilleries through the Alcoholic Beverage Control Division, and conditions the license on a $2,000 surety bond under K.S.A. 41-317 — the same statutory figure that applies to a microbrewery or farm winery. The bond is filed on form ABC-804 and runs to the State of Kansas.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Kansas (the obligee). The bond is conditioned on your compliance with the Kansas Liquor Control Act and the payment of any tax, penalty, or interest you owe under it.

It is not insurance for you — if the surety pays a claim, you repay the surety. A microdistillery that follows the Act and pays its taxes treats the bond as a license formality, not a risk.

K.S.A. 41-317 (microdistillery)K.S.A. 41-317 requires a microbrewery, microdistillery, or farm winery applicant to file a bond with the application, in an amount the statute sets at $2,000, executed by corporate sureties licensed in Kansas and conditioned on compliance with the Kansas Liquor Control Act.
