What the remittance agent bond actually guarantees

Article IX of the Illinois Vehicle Code opens by saying why it exists: to protect the public from people who accept money for remittance to Illinois state agencies and then fail to forward it. That is the whole risk in one sentence. Title and registration service companies, dealer title services, currency exchanges that sell plates and stickers, and anyone else who collects a customer’s title fee, registration fee, or vehicle use tax and sends it on to the Secretary of State is a remittance agent.

The bond runs to the People of the State of Illinois and is conditioned on the proper transmittal of every remittance and the performance of all undertakings connected with it. The penal sum is the greater of $20,000 or the aggregate sum you transmitted to the State during the highest 15-day period in the preceding fiscal year, rounded to the nearest $1,000 — so the bond grows with the float you actually handle rather than sitting at a token number.

The licence is a calendar-year licence: it terminates on December 31 of the year it is issued, and it is renewed on an application filed between September 1 and December 31 of the preceding year. That is why the application here asks you to choose a term and then fixes the expiry on a December 31 date. The other half of the file is not the surety’s: a written application under oath naming every location where you will act, two affidavits from residents attesting to your good moral character and business reputation, and a certificate from the prelicensing education programme. It is not insurance for you — if the surety pays, you reimburse the surety.

625 ILCS 5/3-903 · 625 ILCS 5/3-905Section 3-903 of the Illinois Vehicle Code makes it unlawful for any person to act as a remittance agent in Illinois without first having obtained or renewed a licence and posted a bond. Section 3-905 sets that bond: it runs to the People of the State of Illinois with a surety authorised to do business here, in the minimum sum of $20,000, or in an amount equal to the aggregate sum of money transmitted to the State by the applicant during the highest 15-day period in the fiscal year immediately preceding the one for which application is made, rounded to the nearest $1,000, whichever is greater. It is conditioned upon the proper transmittal of all remittances and the performance of all undertakings in connection with them. Under 92 Ill. Adm. Code 1019.10, the licence terminates on December 31 of the year for which it is issued and may be renewed for the next calendar year on an application filed between September 1 and December 31 of the preceding year. State and federally chartered banks, savings and loan associations, and credit unions can be relieved of the bond by providing a notarised affidavit that they are already sufficiently bonded, and Section 3-902 exempts a person who has already filed a qualifying surety bond in connection with another Illinois business licence. Section 3-904 sets the rest of the application: it is sworn, it names each location at which you intend to act, it discloses litigation, and it carries two good-character affidavits plus your prelicensing education certificate.

Why does the expiry land on December 31?Because the licence does. The term you choose sets which December 31 it runs to, and the price varies with the total term.
What does the bond guarantee?That every remittance you take from a customer for an Illinois state agency is actually transmitted, and that you perform the undertakings that go with it. If money you collected never reaches the Secretary of State, the harmed party can recover against the bond — and you reimburse the surety.
Is my bank or credit union exempt?It can be.
