What the grading bond actually guarantees
The County of Kauai regulates grading, grubbing, and stockpiling through its Department of Public Works (Engineering Division) under Kauai County Code Chapter 22. Disturbing soil on the island without doing it to plan can cause erosion, runoff, and damage to neighboring property — so the County conditions a permit on a bond.
The bond is a performance guarantee to the County: it stands behind your promise to complete the grading work, control erosion, and restore the site to the approved condition. The County Engineer sets the amount — generally the full estimated cost of all the work and services the permit covers, with your cost estimate subject to the Engineer's approval.
It is not insurance for you. If you abandon the work or leave the site out of compliance and the County has to draw on the bond, you repay the surety. Operators who finish to plan treat the bond as a permit formality, not a risk — and we issue it at a flat 3% with no credit check.
