Florida licenses medical marijuana treatment centers through the Department of Health under §381.986, Florida Statutes — the vertically integrated license that covers cultivating, processing, and dispensing marijuana to qualified patients. Upon approval, the applicant must post a $5 million performance bond issued by an authorized surety rated in one of the three highest categories by a nationally recognized rating service.
It's a three-party arrangement: you (the principal), the surety carrier, and the Department of Health (the obligee). The bond stands behind your performance as a licensee — compliance with §381.986 and the department's rules, including payment of any fines the department imposes. The statute also lets an applicant post an irrevocable letter of credit or cash instead, but a surety bond keeps that capital free.
It is not insurance for you — if the surety pays a claim, you repay the surety. The statute does ease the burden as you grow: a treatment center serving at least 1,000 qualified patients may maintain a $2 million bond instead. The bond has to stay continuously on file with the department; we track the term and send renewal notices 60 and 30 days out.
