Florida requires an assisted living facility that holds or manages residents' personal funds — as representative payee or under a power of attorney — to post a surety bond with AHCA under F.S. 429.27. The amount is twice your residents' average monthly funds. Premiums are 1% of the bond amount, $100 minimum.

Florida licenses assisted living facilities through the Agency for Health Care Administration (AHCA). Under F.S. 429.27, a facility that serves as representative payee for a resident or holds a resident's funds under a power of attorney must file a surety bond as part of licensure — a resident-protection guarantee.
The bond runs to the Agency for the benefit of any resident who suffers a financial loss from the misuse or misappropriation of funds the facility holds. The amount is twice the average monthly aggregate of the funds or personal property the facility controls, and never less than $5,000 — and you include the value of any resident property held under power of attorney.
It is not insurance for you. If the surety pays a resident, you repay the surety. A surety that cancels or non-renews must give AHCA at least 30 days’ written notice — so we track your filing and notify you well ahead, keeping it continuous.
