What the Trumbull excavating bond actually guarantees

Under the Town of Trumbull’s street-excavation ordinance, no person may open, excavate, or perform construction work within, on, through, or under a public street, highway, or right-of-way in Trumbull without first obtaining an Encroachment/Street Opening Permit from the Director of Public Works. Before that permit can be issued, the applicant must hold a Town Excavating License and file a surety bond sufficient, in the Director’s opinion, to secure the adequate restoration of the highway after the work is finished.

It is a three-party arrangement: you (the principal), the surety carrier, and the Town of Trumbull (the obligee). If a licensee fails to restore a street to the Director’s satisfaction, the Town can perform the repair itself and recover its cost against the bond.

It is not insurance for you — if the surety pays the Town, you repay the surety. This $10,000 bond is the standard filing amount for the Town Excavating License; the Director of Public Works may require a different amount for a specific permit depending on the scope of work, so confirm your permit’s figure with the Department before filing.

Trumbull Code of Ordinances § 17-112, Art. V (Street Excavations)Chapter 17, Article V, Section 17-112 of the Trumbull, Connecticut Code of Ordinances requires an applicant for a Street Opening Permit to first obtain a Town Excavating License and to file with the Town a surety bond, in an amount the Director of Public Works or his designee considers sufficient to secure adequate restoration of the highway, before an opening permit will be issued.
