What the Anchorage marijuana tax bond covers

Anchorage voters approved a 5% retail sales tax on marijuana and marijuana products, codified at AMC chapter 12.50 and administered by the Treasury Division of the Municipality's Finance Department. Because the retailer collects the tax from customers and holds it in trust, AMC 12.50.160 requires security for fiduciary performance before Treasury issues the Certificate of Registration a retailer needs to operate.

The security amount is the greater of $10,000 or the Chief Fiscal Officer's estimate of the average annual sales tax you will collect — based on your operation, comparable retailers, or industry averages. A surety bond is one of the approved forms (a deposit in escrow or letter of credit are the alternatives); the bond is payable to the Municipality and conditioned on payment in full of the tax, penalties, and interest due during its effective period.

If the retailer fails to remit, the Municipality can recover against the bond — and if the surety pays, you repay the surety. We issue the amount the Municipality set, from $100 in premium, with any credit screen a soft pull that never affects your score.

AMC 12.50.160 (Security for fiduciary performance)Anchorage Municipal Code chapter 12.50 imposes the retail sales tax on marijuana and marijuana products, and section 12.50.160 requires every retailer to provide security guaranteeing payment of the tax — a surety bond from a company authorized in Alaska, a deposit in escrow, or a letter of credit — in the amount the Chief Fiscal Officer estimates as your average annual sales tax or $10,000, whichever is higher. Confirm your required amount with the Treasury Division.
