Before Stafford County issues a land-disturbance permit, County Code § 11-17(a) requires a performance guarantee for the erosion and sediment controls on your plan. A surety bond may carry up to half of that security, with the rest in cash or a letter of credit. A surety specialist returns a quote, usually within one business day.

Stafford will not issue the land-disturbance permit until the E&S security is posted and approved, and the Securities Division wants the whole guarantee at once — the agreement, the bond, and the cash or letter-of-credit half. Getting the bond in hand early keeps the permit from waiting on it. Here is the whole process:
Apply online with the project name, the Performance Agreement number, the project section, the completion date and the bond amount — the surety share of the E&S security the County approved from your certified estimate.
A specialist reviews the project, the developer behind it and the size of the bond share, then returns a quote. The County sets the security from your plan, so underwriting decides approval, price and any collateral — not the amount.
Once you bind, we issue the executed bond with the power of attorney attached, running to the Board of Supervisors of Stafford County, ready to go in with your Developer E&S Performance Guarantee and the cash or letter-of-credit half before the grading permit issues.
In July 2024 Stafford County repealed its old erosion and sediment control chapter and its separate stormwater chapter and re-enacted Chapter 11 of the County Code as a single Erosion and Stormwater Management chapter under the Virginia Erosion and Stormwater Management Program (Ord. No. O24-18). No land-disturbing activity may start without a land-disturbance permit, and the County’s permit application is required to clear, disturb or grade 2,500 square feet or more — except for a single-family residence covered by a building permit.
Section 11-17(a) then says that before any land-disturbance permit is issued, the applicant must submit a reasonable performance bond with surety, cash escrow, a letter of credit, any combination of them, or another arrangement the administrator accepts. It exists so the County can take the measures your permit conditions require — silt fence, inlet protection, sediment traps and basins, stabilization — at your expense if you fail to start or maintain them after proper notice and within the time given. If the County’s cost runs past the security it holds, it can collect the difference from you.
How much is set by the Stafford County Developer Security Policy (amended October 2020), which the Securities Division still links. Section 100.09 requires a separate E&S Performance Guarantee on construction, subdivision, site, grading and infrastructure plans. A qualified professional — a Virginia-licensed engineer or surveyor — prepares a certified estimate of installing, maintaining and completing the controls, the County approves it, and the total security may be no more than 125% of that estimate. A surety bond can carry at most 50% of the total, with the other half in a letter of credit or cash.
It is a three-party arrangement: the developer (the principal), the surety, and the Board of Supervisors of Stafford County (the obligee), which signs the guarantee through the County Administrator. The surety must be rated A or better by A.M. Best and licensed in Virginia (§ 100.02(C)). The initial term runs up to 24 months, extensions come a year at a time up to five years in total, and when the security is stepped down the surety bond is reduced first, before the cash or letter of credit (§ 100.05(B)(1)). The security is returned within 60 days once the site is adequately stabilized and the controls are removed and approved.
A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.
The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.
Term and renewal are set in the underwriter's quote.
Keep the bond in force for as long as the obligation behind it runs.

This bond is underwritten: the premium is quoted from the bond amount and your financial picture, so there is no flat price to show.
