What the liquor bond actually covers

Minnesota licenses manufacturers and wholesalers of alcohol through the Department of Public Safety's Alcohol and Gambling Enforcement Division (AGED). Under Minn. Stat. 340A.301, subd. 4, the commissioner may not issue the license until the applicant files proof of financial responsibility — a corporate surety bond, cash, or U.S. government bonds payable to the state.

The bond is conditioned on the licensee obeying all laws governing the business and paying when due all taxes, fees, penalties, and other charges, and it is forfeited to the state on a violation of law. The statutory amounts are $10,000 for intoxicating liquor, $5,000 for wine, and $1,000 for malt liquor (beer) by product type.

It runs to the state, not to you — if the surety pays a claim, you repay the surety. Filed on form PS 9012-02, it is one of the items AGED checks before issuing your manufacturer or wholesaler license.
