Indiana taxes diesel and other special fuels under IC 6-6-2.5. A transporter is a licensed carrier that hauls special fuel by truck, rail, or barge into, out of, or across the state. Transporters do not usually owe the fuel tax themselves, but they must be licensed and report the movements they make so the state can trace fuel through the chain.
Under IC 6-6-2.5-44, the commissioner can require a transporter to post a bond no less than $2,000 and no more than the estimated two-month tax liability, conditioned on accurate records and complete reports of the fuel transported. Because transporters rarely hold tax liability, this bond is often at or near the $2,000 floor.
