IC 32-30-5-3 governs the receiver’s oath and undertaking. Before entering on the duties of the receiver, the receiver must (1) swear to perform the duties of a receiver faithfully, and (2) with one or more sureties approved by the court or judge, execute a written undertaking to faithfully discharge the duties of receiver in the action and obey the orders of the court or judge. IC 32-30-5-1 sets out when a receiver may be appointed, including where the property, fund, or rents and profits in controversy are in danger of being lost, and IC 32-30-5-2 bars the court from appointing a party, a party’s attorney, or another interested person as receiver.
