Idaho Appellate Rule 13(b)(15) provides that a money judgment may be stayed upon the posting of a cash deposit or supersedeas bond, in the amount of the judgment or order plus 36% of that amount, issued by a surety authorized to do business in Idaho. Idaho Code § 13-202 governs the stay of proceedings pending an appeal to the Supreme Court. Any objection to the sufficiency of the bond must be raised by motion within 21 days of its filing; for punitive damages, the bond requirement is waived as to the portion of punitive damages exceeding $1,000,000.
