Delaware’s procurement code, 29 Del. C. § 6962(b), requires every bid on a large public works contract to be accompanied by bid security — a bond or assigned security equal to at least 10% of the bid — returned to the successful bidder once the formal contract and performance bond are executed. Federal construction over $150,000 requires bid security under the Miller Act. Many Delaware agencies also require a consent of surety with the bid; we furnish it with the bond at no charge.
