Section 23-39-505 of the Fair Mortgage Lending Act sets the qualifications for licensure, and subsection (f) requires mortgage servicer applicants to post a surety bond. Under the FMLA rules, a mortgage servicer's bond is based on the aggregate Arkansas residential mortgage loans held in its portfolio during the preceding calendar year — $100,000 at $10 million or less, $150,000 above $10 million to $25 million, and $200,000 above $25 million — and the full amount must be in effect at all times.
