The purpose of this Solicitation and resultant Contracts is to provide Authorized Users with a means of acquiring Photovoltaic Systems (Lot 1), Photovoltaic Services (Lot 2), Solar VDER Subscriptions (Lot 3), and Solar Power Purchase Agreements (Lot 4). A Bidder is not required to bid on every Lot; a Bidder may bid on as few or as many Lots as desired.

For each Lot, it is OGS’s intent to award Contracts to all Responsive and Responsible Bidders meeting the minimum requirements established in the Solicitation for that Lot, whose Products meet the Scope and Specifications of this Solicitation, whose prices indicate that those Products will be provided at a reasonable price as determined by OGS, and who are eligible for award under that Lot. The Centralized Contracts will be multiple-award Back-Drop Contracts which will qualify awarded Bidders to be eligible to submit responses to Requests for Quotes (RFQs) issued at a later date by Authorized Users.

This Solicitation, and the resultant Contracts, is not related to the NYS legislation that gives New York Power Authority (NYPA) additional authority to advance renewable energy generation and decarbonization in NYS (see https://www.nypa.gov/news/press-releases/2023/20230503-legislation). This Solicitation, all Back-Drop Contracts resulting from this Solicitation, and any Authorized User Agreements resulting from RFQs are separate from and unrelated to the NYS Public Power for Public Entities (PPPE) initiative, as announced in Governor Hochul’s 2025 State of the State (see https://www.governor.ny.gov/news/governor-hochul-commits-more-1-billion-tackle-climate-crisis-single-largest-climate-investment).

Contractor shall provide Authorized Users with the option to purchase Renewable Energy Certificates (RECs) following New York State policies. If requested by Authorized Users, Contractor shall provide Authorized Users with the option to forgo payment for Environmental Value (E Value) at the Authorized User’s discretion during RFQ.

Solicitation Update Instructions: Submission of responses by a vendor to a solicitation that does not account for updated information may result in their bid/offer being deemed non-responsive. Vendors are strongly encouraged to review the advertised solicitation in full prior to submitting a bid to ensure inclusion of any updated information. Additionally, if the vendor does not opt-in to receive notification updates regarding a particular solicitation, they will not receive e-mail notifications regarding updates, including e-mail notifications regarding the posting of the question-and-answer documents and updates to solicitation documents. To receive email notifications regarding updates to the content or status of a particular solicitation, the vendor must choose the option “bookmark the ad” located in the upper right-hand side of the ad, then return to their account, view their list of bookmarked ads, and then select the “send me notification updates” option listed to the right of the ad.”

Procurement Lobbying Information: Pursuant to State Finance Law § 139-j and § 139-k, this Solicitation includes and imposes certain restrictions on communications between OGS and a Bidder during the procurement process.
