All bidders shall review the Specifications to determine the applicable goal requirements. If appliable, all bidders are
required to submit Forms CR-266, CR-273, and if applicable, Forms CR-272 and CR-274 with trucker/hauler supporting
documentation (including all “Good Faith Effort” documentation) with the bid or within 5 days after bid opening via email
to DOT-CR.Verifications@dot.nj.gov.
N.J.S.A. 34:1A-1.16 authorized the New Jersey Department of Labor and Workforce Development (NJDOL) to create a
list on its website, dubbed the Workplace Accountability in Labor List (WALL), of any person found in violation of any
State wage, benefit, and tax laws and against whom a final order has been issued by the NJDOL for such violation. Any
person or business named on the WALL is prohibited from contracting with the Department until that person or business
has been removed from the WALL. The WALL is found at https://www.nj.gov/labor/ea/osec/wall.shtml
Certification of Non-Involvement in Prohibitive Activities in Russia or Belarus pursuant to N.J.S.A. 52:32-60.1. On the
“Certification of Non- Involvement in Prohibitive Activities in Russia or Belarus Form” provided by the Department, certify
pursuant to N.J.S.A. 52:32-60.1, that neither the Bidder nor its affiliates are engaged in prohibited activities in Russia or
Belarus as defined therein.
On the "Certification of Non-Debarment Form" provided by the Department, certify pursuant to N.J.S.A. 52:32-44.1, that
neither the Bidder, nor its affiliates are debarred at the federal level from contracting with a federal government agency.
In addition, all Bidders must register with the federal System for Award Management (SAM) prior to contract award. ln
order to comply with this requirement, Bidders must register in SAM at https://www.sam.gov and the Department will
verify the successful Bidder's registration in SAM prior to contract award.
For Projects subject to the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 to .98, an acknowledgement that the
Bidder accounted for the prevailing wage rate in their bid pricing and that the Bidder agrees to pay the prevailing wage
rate if awarded the Contract.
By submitting its bid to the Department, the Bidder warrants that no person or selling agency has been employed or retained by the Bidder
to solicit or secure such Contract upon an agreement or understanding for a commission, percentage, brokerage or contingent fee, except
bona fide employees or bona fide established commercial or selling agencies maintained by the Bidder for the purpose of securing
business, for the breach or violation of which warranty the Department shall have the right to annul such Contract without liability or in
its discretion to deduct from the contract price or consideration the full amount of such commission, percentage, brokerage or contingent
fee as required by N.J.S.A. 52:34-15.

Pursuant to N.J.S.A. 34:11-56.35(d), if the Commissioner of the Department of Labor and Workforce Development (LWD Commissioner)
makes an initial determination that an employer has violated the provisions of P.L.1963, c.150 (C.34:11-56.25 et seq.) by paying wages
at rates less than the rates applicable under that act, the LWD Commissioner may immediately issue a stop-work order to cease all
business operations at every site where the violation has occurred, and may assess a civil penalty of $5,000 per day against the employer
for each day it conducts business operations in violation of the stop-work order. If the stop-work order is issued against a subcontractor,
the general contractor may terminate that subcontractor from the project in accordance with N.J.S.A. 34:11-56.35(d).
Pursuant to the DIANE B. ALLEN EQUAL PAY ACT, N.J.S.A. 34:11-56.14(b), the Contractor shall provide to the Commissioner of the New
Jersey Department of Labor and Workforce Development, through certified payroll records required pursuant to P.L.1963, c.150 (C.34:11-
56.25 et seq.), information regarding the gender, race, job title, occupational category, and rate of total compensation of every employee
of the employer employed in the State in connection with the Contract. The Contractor shall provide the Commissioner, throughout the
duration of the Contract, with an update to the information whenever payroll records are required to be submitted pursuant to P.L.1963,
c.150 (C.34:11-56.25 et seq.).

Pursuant to N.J.S.A. 52:25-24.2, no corporation, partnership, or limited liability company shall be awarded any contract nor shall any
agreement be entered into for the performance of any work or the furnishing of any materials or supplies, unless prior to the receipt of
the bid or proposal, or accompanying the bid or proposal of said corporation, said partnership, or said limited liability company there is
submitted a statement setting forth the names and addresses of all stockholders in the corporation who own 10 percent or more of its
stock, of any class, or of all individual partners in the partnership who own a 10 percent or greater interest therein, or of all members in
the limited liability company who own a 10 percent or greater interest therein, as the case may be.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. (P.L 1975, c. 127); N.J.A.C. 17:27-3.8.
Bidders are required to comply with the requirements of Title VI of the Civil Rights Act of 1964. Specifically, the contractor, sub recipient
or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor
shall carry out applicable requirements of 49 C.F.R. Part 26 in the award and administration of DOT-assisted contracts. Failure by the
contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or
such other remedy as the recipient deems appropriate.
Pursuant to N.J.S.A. 52:32-44, contractor must submit the Department of Treasury, Division of Revenue Business Registration of the
contractor and any named subcontractors prior to contract award or authorization.
Pursuant to N.J.S.A. 34:11-56.51, contractors must be registered with the New Jersey Department of Labor and Workforce Development,
Division of Wage and Hour Compliance at the time of bid.
Bids for the above project will be downloaded from the Bid Express website on the Project Bid date (subject to change by addenda) at 10:00:59
a.m. prevailing time and will be read aloud immediately thereafter. The Bidder must upload their bid prior to the hour named so that it is
included in the letting download. Late bids cannot be accepted. This is the only vehicle to bid this project; paper bids will not be accepted.
General wage determinations issued under Davis-Bacon and related acts, published by US Department of Labor, may be obtained from the
Web Determinations online web site at http://www.wdol.gov/dba.aspx.
Minimum wage rates for this project shall be as specified in the "Prevailing Wage Determination of the New Jersey Department of Labor and
Workforce Development" on file with this Department. The attention of bidders is directed to the provisions covering subletting or assigning the
contract to Section 108-Prosecution and Completion of the New Jersey Department of Transportation Standard Specifications. The entire work is
to be completed on or before the ESTIMATED COMPLETION DATE STATED ABOVE.

DOT reserves its right to reject any or all bids in accordance with N.J.S.A. 27:7 -30 and N.J.S.A. 27:7-33.
