Sealed Proposals, invited by the County of Nassau, will be received by the County Executive of Nassau
County, in the office of the Clerk of the Nassau County Legislature, Room 117, in the Theodore
Roosevelt Executive and Legislative Building, 1550 Franklin Avenue, Mineola, New York, on Tuesday,
August 11th, 2026 until 10:30 am, at which time the Proposals were accompanied with and presented
separate from the required Bid Security will be publicly opened and read aloud, in the Meeting
Room of the Nassau County Legislature, and the contract awarded as soon thereafter as practicable.
Vendors doing business with Nassau County, including those responding to this solicitation, must
register with the County. The Nassau County Bid Solicitation Boards are open to all registered
vendors. Vendors that have not registered are able to view open solicitation opportunities, but they

Instructions to Bidders, Form of Bid Bond, Proposal, Form of Agreement, Specifications and the Plans,
herein called the “Contract Documents”, may be examined at the Permit Office of the Department of
Public Works, first floor, 1194 Prospect Avenue, Westbury, Nassau County, New York, 11590-2723, Phone
No. (516) 571-6840, from 9:00 AM on Friday, July 10th, 2026 until 3:45 PM on Friday, August 7th,
2026 (closed from 12:00 Noon to 1:00 PM, and on County Holidays). Copies of the Bid Contract
Documents for use in bidding will be available for purchase at the Permit Office. Furthermore, a
downloadable set of the technical specifications FOR INFORMATIONAL USE ONLY (NOT to beused
forbidding) can be found on the County solicitation board at no charge for all registered users
at: https://apex5.nassaucountyny.gov/ords/f?p=533:226.To access these documents, click on the
“Vendor Portal” link. Once you are in the Vendor Portal, click on "Nassau County Procurement," and,
under "Formal Solicitation," access and download the Request for Bid Contract Documents. Vendors

will not be able to download Solicitation documents. Only bid documents purchased at the Permit
Office can be used for bidding.
In order to submit a bid, a non-
refundable fee of $300.00 by check or money order, payable to the Nassau County Treasurer, will be
required for each set of Bid Contract Documents purchased from the Permit
Office. Prospective bidders requesting Contract Documents by mail must remit an additional, non-
refundable, fee of $30.00 per set to cover handling and first-class mailing.

Performance Bond/Bid Security
Security for Bid as set forth herein must be presented with the Bid.
“FAILURE TO PROVIDE THE REQUIRED SECURITY WILL RENDER THE BIDDER NON- RESPONSIVE AND THE
BID WILL NOT BE ACCEPTED, OPENED OR READ ALOUD. IN ADDITION, FAILURE TO PROVIDE THE
REQUIRED SUBCONTRACTOR INFORMATION AT THE TIME OF BID OPENING MAY RENDER THE BIDDER
NON- RESPONSIVE”.
SUBCONTRACTOR LISTS - In accordance with GML § 101, for projects (1) to which a project labor
agreement applies, (Labor Law Section 222) and, additionally, (2) on a public work contract for which
separate specifications have not been prepared, each Bidder shall
submit with its bid a separate sealed list on the forms provided with the proposal
forms that names each subcontractor (for the enumerated work, if applicable) that the Bidder
intends to use to perform work on the contract. Notwithstanding the forgoing, all subcontractors
must be approved by the Commissioner in writing prior to such subcontractor’s performance of any
work.
MWBE UTILIZATION PLAN – In accordance with Title 53, Nassau County Local Law No.14-2002, all
bidders shall submit a MWBE Utilization Plan with their bid.
All Vendors shall submit a Completed Appendix C: Offeror’s Affirmation of Understanding of and
Agreement Pursuant to State Finance law § 139-j(3) and § 139-j(6)(b).

This Contract will be subject to Nassau County Local Laws No. 14-2002, “Participation by Minority
Group Members and Women in Nassau County Contracts,” which requires submission of a
Utilization plan prior to the award of a County contract, No. 2-2016, “Participation of Service-
Disabled Veterans in County Contracts,” and No. 9-2002, as amended by No. 3-2015, which require
that firms entering into contracts with Nassau County must participate in registered and approved
apprenticeship training programs unless such requirement are supplanted by requirements specified
in the bidding instructions. At the time of bid submission, the Contractor shall submit, as part of its
bid, documents in compliance with Title 51 of the Nassau County Miscellaneous Laws demonstrating
participation in approved apprenticeship training programs that are appropriate for the type and
scope of work to be performed pursuant to the Contract. Such apprenticeship training programs
appropriate for the scope of this Contract shall include, but are not limited to the following:
Laborers, Operating Engineers, Electricians, or any other trade appropriate for the type of work
proposed. The apprenticeship training programs shall be registered with, and approved by, the New
York State Commissioner of Labor in accordance with Article 23 of the New York State Labor Law.
Note that if the Contractor does not comply with these requirements, the Commissioner may
declare the Contractor's bid proposal non-responsive and award the Contract to the next lowest
responsible Bidder.

IMPORTANT INFORMATION FOR BIDDERS
Effective immediately, no Contractor may submit a bid for public work in New York State unless they
are registered with the NYS Department of Labor. Bids received from unregistered Contractors shall be
deemed non-responsive. Additionally, no Subcontractor my commence work on a public work project
unless they are registered with the NYS Department of Labor. Requests for approval of unregistered
Subcontractors will be denied. Further information is available at Public Work Contractor and

Work Description
The Glen Cove Avenue Retaining Wall project consists of the removal of an existing stacked stone wall and
replacement with a new 400-feet reinforced concrete wall. Temporary sheeting will be required behind
the new wall. A new ADA compliant sidewalk and chain link fence will be placed along the entire length
including the wall section to remain. There are tapered high curbs at each end of the wall along with new
sidewalks which meet existing curbs and sidewalks. Fences and various small walls that border private
properties will be maintained or modified and a new variable depth curbs/retaining walls added adjacent
to these private walls. The project includes the removal of trees, trimming of other overhanging trees, and
minor grade restoration at the south end. Utility poles and a fire hydrant will be relocated by their owners
prior to construction.
Your bid shall be based upon a Notice to Proceed to be issued in the 3rd Quarter of 2027.
