The State of Montana Department of Environmental Quality (DEQ) is seeking a third-party contractor to
provide an environmental impact statement (EIS) of the Montana Resources Amendment 012 permit. The
Contractor will prepare an EIS analyzing the potential environmental impacts of the Project authorizing the
Project in accordance with the Montana Environmental Policy Act (MEPA) and National Environmental Policy
Act (NEPA). A complete description of the project, work requirement, and proposal development/submittal
requirements are provided specifically in the Request for Proposals (RFP) document posted on the Questions
page and throughout the entirety of this event, generally. All submittals must follow the directions, guidance,
instructions, etc. set forth within all documents, prerequisites, questions, and Q&A Board responses.
Offerors seeking technical assistance, such as submittal issues, must contact the eMACS Help Desk at 406-444-
2575 or emacs@mt.gov.
Be sure to fully review your response to ensure you answered all questions, accepted all required information,
and uploaded all documents. The State is not responsible for documents that may have been overwritten and/or
not fully loaded and the system does not accept partial submittals.

1. Read and accept the Single Point of Contact (Procurement Officer) information.
2.
Read and accept Montana's Standard Terms and Conditions. Use the Exceptions table for all you want the
State to consider and submit the Exceptions form to the Q&A Board by the Questions submittal deadline.
Failure to request exceptions during the Q&A period will result in your agreement to them as written and no
consideration to negotiate will be granted except for non-material changes at the State's option.
3. Read and accept RFP information.

Read and accept the Draft Contract. Any exception requests must be submitted on the Exceptions form.
See related prerequisite for requirements. Failure to make requests during the Q&A period and submitting
a response will indicate your understanding and agreement to said terms and conditions; the State will not
consider material changes after the Q&A period and solicitation close. The State reserves the right to
make non-material changes.
5. Read and accept Document Upload information.

Use this form to request ALL Draft Contract and Montana's Standard Terms and Conditions exceptions
you want the State to consider modifying. Only one form is required. Upload to the Q&A Board by the
Questions submittal deadline. Only requests submitted by that deadline will be considered-the State will
not entertain any changes at any point after this deadline. In order for the State to consider requested
changes, the form must be filled out in each column; requests without that information will automatically be
rejected and the requirement/verbiage will remain as originally published. See associated prerequisite for
additional information. The State reserves the right to accept, reject, or negotiate any or all requests and
provide response(s) past the anticipated Answer posting deadline if legal review/negotiations necessitate a
longer term to decide.

Read and accept the Insurance Requirements information. The State highly recommends offerors share
this information with their agent to ensure they will be able to obtain and meet all types, limits, and
endorsements before the Question submittal due date. Remember, all requests for exceptions or
deviations must be submitted on the Exceptions form.
8. Read and accept Q&A Certify and Submit information.
9. Read and accept Estimated RFP Timeline
10. Review and accept Warranty for Services information.
11. Review and accept the Registration with Montana Secretary of State information.
12. Review and accept the Debarment information.
13. Offeror must certify their ability to enter this proposal and be legally bound to the RFP.

Equal Pay for Montana Women. Offerors who agree and certify compliance to

5% of the total points available. Offerors who do not comply will not receive bonus
points.
