RCW 19.146.205 requires each applicant for a Washington mortgage broker license to file and maintain a surety bond in an amount the director deems adequate to protect the public interest, running to the state of Washington as obligee and running first to the benefit of the borrower and then to the state and any person who suffers loss. The statute directs the director to establish by rule a range of bond amounts that vary according to the licensee's annual loan origination volume. WAC 208-660-175 sets those tiers: $20,000 for zero to $20 million, $40,000 for $20 to $40 million, and $60,000 at $40 million or more, with $20,000 for a licensee that only offers residential mortgage loan modification services.
