Chapter 10.08 of the Lummi Nation Code of Laws (Title 10, Natural Resources Code) requires every buyer purchasing fish or shellfish from Lummi fishers to hold an annual Buyers License from the Lummi Indian Business Council. Section 10.08.040, "Buyers Required to Post Bond," states that the bond’s purpose is to ensure the Nation receives all required taxes and surcharges, and — unless the Finance Director sets other terms in consultation with the Fisheries Commission — sets the bond at $20,000 or 200% of the tribal tax the buyer collected or should have collected during the preceding fishing season, whichever is greater; a buyer with no purchase history posts the equivalent of three months of expected tax instead.
