About this bond

What the health spa bond actually covers

Utah’s Health Spa Services Protection Act (Utah Code Title 13, Chapter 23) requires a health spa that collects prepaid fees to register each facility with the Division of Consumer Protection and post security. The bond is payable to the Division for the benefit of any consumer who is damaged because the spa violates the Act or goes out of business.

The required amount is tiered by the number of paid-in-full membership contracts you have sold: $15,000 for 500 or fewer, $35,000 for 501–1,500, $50,000 for 1,501–3,000, and $75,000 for 3,001 or more. A surety bond is one of the accepted forms of security, alongside a letter of credit or certificate of deposit.

Some businesses are exempt — yoga studios, martial-arts businesses, nonprofits, and operations that only sell individual classes or low-cost session packages may not have to register or bond at all. Enter the figure your situation requires, and we issue the bond at a flat 3% with no credit check.

Utah Code § 13-23-6 (Health Spa Services Protection Act)Under Utah Code § 13-23-6, a health spa that collects prepaid fees must register each facility with the Division of Consumer Protection and maintain a surety bond, letter of credit, or certificate of deposit payable to the Division for consumers damaged by a violation or closure. The amount is tiered by paid-in-full contracts sold: $15,000 (≤500), $35,000 (501–1,500), $50,000 (1,501–3,000), $75,000 (3,001+). Some operations are exempt — confirm your tier and whether you must register.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Utah health spa bond? +
The premium is a flat 3% of the bond amount, with a $275 minimum. The amount itself is tiered by your paid-in-full contract count — $15,000, $35,000, $50,000, or $75,000. Enter the figure that applies and the quote updates.
Why does Utah require this bond? +
Under the Health Spa Services Protection Act (Utah Code 13-23-6), it protects members’ prepaid dues. If a spa closes or violates the Act, the security pays damaged consumers — it is held by the Division of Consumer Protection for their benefit.
Which tier am I in? +
It is based on paid-in-full membership contracts sold: $15,000 for 500 or fewer, $35,000 for 501–1,500, $50,000 for 1,501–3,000, and $75,000 for 3,001 or more. Send us your count and we’ll confirm.
Is there a credit check? +
No — the health spa bond is issued with no credit pull. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
Am I exempt? +
Possibly. Yoga studios, martial-arts businesses, nonprofits, and operations that only sell individual classes or low-cost session packages may be exempt from registering and bonding under Utah Code 13-23-2. Check with the Division of Consumer Protection if you are unsure.
