Texas disposal-well operations are governed by Railroad Commission rule 16 TAC § 3.9, with disposal of saltwater and oil-and-gas waste also subject to Water Code Chapter 27 and Title 3 of the Natural Resources Code. Rule 3.9 carries no bond provision; the performance-bond authority is Natural Resources Code § 91.109, under which a person applying for or acting under a Commission permit to store, handle, treat, reclaim, or dispose of oil and gas waste may be required to maintain a performance bond or other form of financial security conditioned that the permittee will operate and close the site in accordance with state law, Commission rules, and the permit. The amount is set by the Commission — confirm it on your permit or notice.
