What the damage bond actually covers

New Mexico's Commissioner of Public Lands grants easements and rights-of-way across state trust land for roads, pipelines, utility and power lines, and similar uses under 19-7-57 NMSA 1978. The grantee must compensate the state — or its lessee, patentee, or purchase-contract holder — for the reasonable value of any measurable damage done to improvements or other property lawfully on the land burdened by the right-of-way.

To secure that obligation, the applicant files a bond with the Commissioner before the easement or right-of-way issues, in an amount the Commissioner determines is sufficient to cover the damages. The rules also allow a $25,000 blanket bond — or another amount the Commissioner sets — to cover more than one easement or right-of-way the grantee holds with the State Land Office.

The bond stands behind the damage you might cause, not your own losses. If a covered party is harmed and the surety pays, you repay the surety — it is a guarantee, not insurance for you. Enter the amount on your right-of-way conditions and we issue it at a flat 3% with no credit check.

19-7-57 NMSA 1978 (19.2.10 NMAC)Section 19-7-57 NMSA 1978 empowers the Commissioner of Public Lands to grant easements and rights-of-way across state trust land and requires the holder to compensate the state, its lessees, patentees, or contract holders for the reasonable value of any measurable damage to improvements or property. Under the State Land Office rules (19.2.10 NMAC), before an easement or right-of-way issues the applicant files a bond in an amount the Commissioner determines sufficient to cover such damages, and a $25,000 blanket bond (or another amount set by the Commissioner) may cover more than one right-of-way. Confirm your amount on your right-of-way conditions.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the New Mexico right-of-way damage bond? +
The premium is a flat 3% of the bond amount, with a $275 minimum. The amount is set by the Commissioner of Public Lands; a $25,000 blanket bond is commonly used to cover more than one right-of-way. Enter your required amount and the quote updates.
Why does the State Land Office require it? +
Under 19-7-57 NMSA 1978, an easement or right-of-way holder must compensate the state and its lessees for measurable damage to improvements and property on trust land. The bond, filed before the right-of-way issues, secures that obligation.
Can one bond cover several rights-of-way? +
Yes. The State Land Office rules allow a $25,000 blanket bond — or another amount the Commissioner sets — to cover more than one easement or right-of-way you hold. Confirm the amount with the Commissioner and we issue exactly that.
Is there a credit check? +
No — the damage bond is issued with no credit pull. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
What does the bond protect against? +
The reasonable value of measurable damage you do to improvements or property — belonging to the state, its lessees, patentees, or contract holders — that is lawfully on the land your right-of-way crosses. If the surety pays a claim, you repay the surety.
