Why replevin needs a double bond

Replevin (claim-and-delivery) lets you recover specific personal property — a vehicle, equipment, inventory — that someone is wrongfully holding, before the lawsuit ends.

Because the property changes hands before a judge decides who is right, New Mexico requires the plaintiff to file an affidavit and post a bond that protects the defendant if the seizure turns out to be wrong. That is why § 42-8-6 sets the penal sum at double the value of the property.

If the plaintiff loses, § 42-8-11 lets the court enter judgment against the plaintiff and the sureties for the value of the property plus damages, at the defendant’s option. Because the amount tracks the property, the surety underwrites the file and may require collateral on a large penal sum.

New Mexico StatuteNMSA 1978, §§ 42-8-1 through 42-8-22 govern the action of replevin and the writ for delivery of personal property. Before the writ issues, the plaintiff files an affidavit under § 42-8-5, and under § 42-8-6 gives a replevin bond in double the value of the property, conditioned to prosecute the action and return the property or pay its value and damages if return is adjudged. Under § 42-8-11, judgment may be entered against the plaintiff and the sureties for the value of the property plus damages, at the defendant’s option.
