What the cost bond actually covers

When a plaintiff resides out of state, or is a foreign corporation, Nevada lets the defendant require security for the costs and charges that may be awarded against the plaintiff, by filing and serving a written demand within the time for answering. That security is governed by NRS 18.130.

The undertaking is in an amount not exceeding $500, and a defendant may demand it for each defendant the plaintiff has sued. It guarantees that if the plaintiff loses and costs are awarded, the defendant can recover those costs against the bond rather than chasing an out-of-state party.

If no undertaking is filed within 30 days after the demand (or an order for new or additional security), the court may dismiss the action. We issue the surety undertaking the demand calls for at a flat 3% with no credit check, ready to file before the deadline runs.
