Under 807 KAR 5:006, Section 8, a utility regulated by the Kentucky Public Service Commission — including a rural electric cooperative corporation such as Southern Kentucky RECC — may require from a customer a minimum cash deposit or other guaranty to secure payment of bills, except from customers qualifying for service reconnection under Section 16. Where actual usage data is available at the same or a similar premises, the deposit is calculated using the customer’s average bill for the most recent 12-month period; deposit amounts may not exceed two-twelfths (2/12) of the customer’s actual or estimated annual bill for monthly billing, three-twelfths for bimonthly, or four-twelfths for quarterly. Interest accrues on deposits at the rate prescribed by KRS 278.460 and is refunded or credited annually; on termination of service, the deposit and accrued interest are credited to the final bill, with any remainder refunded.
